Terms and Conditions

 
All orders placed are subject to our standard terms and conditions outlined below. Online payment is not possible if the terms and conditions are declined. These terms do not supercede statutory rights under the Sale of Goods acts but are designed to clarify the principles and procedures by which we operate.

Our overall objective is to be "Fair, Reasonable and Honest", but we appreciate, and hope that you do, that this is a two-way street. We believe that with goodwill almost anything can be resolved to a reasonably satisfactory conclusion and that in the absence of goodwill, almost nothing worthwhile can ever be achieved.

Language & Currency:

All the products on this site are only available in the English language.

All prices on this site are quoted in pounds sterling. Payments must be made in pounds sterling (credit cards sales will be charged in your local billing currency by your credit card provider). A currency converter is provided on the Order Summary page which allows you to check the approximate local currency cost before finalising your order. The actual rate charged will be dependent upon your credit card issuer.

Shipping/Carriage:

The final price quoted on the Order Summary page is the price of the goods including delivery to the stated destination. Goods are despatched using one of Royal Mail's insured delivery service though we reserve the right to select alternative carriers entirely at our own discretion.

Royal Mail UK delivery times are generally between 7:30am and 5:30pm. All orders sent require a signature on delivery. Gift packs should therefore be sent to an address where someone is available to sign - for example place of work. We do not ship to PO BOX addresses. If nobody is available Royal Mail will leave a card detailing how you can collect the package. International delivery arrangements will vary depending on the national carriers procedures.

Standard Gift Packs: are despatched within 5 working days, from the date cleared payment was received. Delivery, excluding day of posting and counting only working days, would normally take a further 2 days (UK), 3 days (Western Europe), 4 days (Eastern Europe) or 5 days (Rest of World) although a maximum of 28 days from the date of ordering should be allowed for delivery.

Express Gift Packs: are despatched within 1 working day of receiving full, cleared payment. For most UK postcodes delivery will be the working day after despatch. International deliveries would normally take, excluding posting day and counting only working days, 3 days (Western Europe), 4 days (Eastern Europe) or 5 days (Rest of World) although these cannot be guaranteed.

Please note that at certain times of the year, such as Christmas, we will highlight "last order" deadline dates for the occasion and may restrict such orders to a particular service ie Standard or Express.

Damage, Delay & Loss in Transit:

If your gift pack is damaged in transit, please advise us as quickly as you can. We never knowingly ship damaged goods and will replace the damaged items as long as we receive your claim within 28 days of the date we despatch the goods.

If you do receive a damaged parcel, note the fact on the delivery note, even before you open the package to examine the contents. If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as "Damaged package; goods not yet inspected" or similar. This enables us to reclaim the cost of replacing the goods from the carrier. Please do not return damaged goods, unless and until requested to do so as this may incur additional costs unnecessarily.

We accept no liability for orders being lost in the post or for delivery delays resulting from postal strikes or other reason(s). We will send replacements (or offer a refund) once written confirmation of non-delivery has been received from the intended recipient and Royal Mail have investigated and accepted a compensation claim for the missing item(s). If you do not receive your goods within the delivery terms stated in the 'Shipping/Carriage' section above you must notify us within 35 days of the date the order was placed.

Payments:

We accept payment by a variety of means including online credit card payments. Other methods are available and we will always keep your information confidential. We do not offer credit facilities to either individuals or corporate clients. Gift pack preparation will commence on receipt of the order payment.

Price and Cancellation:

All prices are quoted in pounds sterling and are inclusive of VAT but exclusive of delivery charges, unless otherwise stated. Customers shipping gift packs to addresses outside the European Union (EU) should note that many countries levy import tax / customs duties on imported goods which are payable by the recipient. We accept no liability for these charges.

Order acceptance and the completion of the contract between you and us will take place once your order has been prepared for despatch.

We reserve the right to decline your order if any of the following apply:

» We have insufficient stock to deliver the goods ordered
» A pricing or product description error has been identified
» We are unable to deliver to the address specified
» The personalsed certificate text is threatening or offensive
» Your payment has not been authorised, received or cleared
» We have reasonable grounds to suspect the transaction is not genuine.

If your order is cancelled by us, we will notify you by email. We will not be liable for compensation of any kind in this instance. You may cancel your order at any point up to the time of despatch. An administration fee of £6.00 will be charged for each individual gift pack cancelled, if the cancellation instructions are received before despatch but after the gift pack has been prepared.

Returns and Refunds:

You may return the gift pack, in its original condition and packaging and at your own expense, for a refund for any reason within 28 days of the gift pack despatch date. This exceeds your statutory rights under current UK Distance Selling Regulations for personalised goods.

We will deduct an administration charge of £6.00 plus the postage costs we have incurred for each individual gift pack returned, to cover the cost of items personalised to your instructions. In addition, if you benefitted from a discount when you placed your order, we will recalculate the discount based on your order less returns and deduct the difference from the refund payable. Please note that refunds will normally be made using the same method as the original payment. (i.e.: a credit card purchase will be refunded through your credit card account).

Any gift pack which is returned by Royal Mail will, at our discretion, be treated as a refund request unless re-delivery arrangements have been agreed (delivery charges may apply).

Please note that we are unable to replace or offer refunds for gift packs which have been misdirected (and not returned) using your delivery instructions or goods that are received damaged and you do not sign for it as "Damaged package" or similar where the carrier subsequently declines to compensate Universal-Gifts.com.

Novelty Gifts / Gift Pack Content:

Star Naming is a novelty gift and as such does not confer or imply legal ownership of the star named. The star name chosen and registered in our records is symbolic rather than a scientific or internationally recognised naming. By purchasing a gift set from us you are confirming that you understand and accept these points.

All images, descriptive material and specifications are representative of the contents of the gift sets. Please note that content varies dependant upon the gift set ordered. We reserve the right without notification to you to alter the content when necessary due to unavailability of an item. It will be replaced wherever possible with an equivalent item of equal value.

Payment & Retention of Title:

Under normal circumstances, goods must be paid for prior to despatch. If, for any reason, goods are shipped prior to clearance of payments, title in the goods shipped belongs to Universal-Gifts.com until payment in full for the goods is received by us. Conversely, we will not normally process payment for goods until they are available for despatch. However, please note that on-line transactions are normally actioned automatically whilst you are on-line to the secure transaction server.

Goods Not Available For Shipment:

With the best will in the world, some goods may not be in stock at the time you place your order. In the event that we cannot ship your goods within 5 working days (1 working day - Express Service) of receipt of your order, we will contact you to advise the actual situation (provided that contact information has been provided) and take instructions from you on how you would prefer us to proceed.

Confidentiality:

We undertake to exercise all reasonable precautions to keep information supplied to us by customers strictly confidential. We do not supply our “mailing information” to third parties but do use it to advise our clients of goods and services we feel may be of interest to them, unless expressly instructed otherwise in writing. Information supplied to us may be stored on a computer system for our convenience, but will not be supplied to any outside agency.

Extent of our Liability:

To the extent permitted by law, we shall not be liable to you for any indirect or consequential loss or damage and we shall have no liability to you for any indirect or consequential loss that is caused by any event or circumstance beyond our reasonable control which shall include, but not be limited to, acts of god, flooding, war, industrial action.

If the goods you receive from us are not what you ordered, or are damaged prior to the point of delivery, you must notify us within 28 days of the despatch date and we will either make good any error that we are responsible for or replace or repair any part of the gift that is damaged or defective - evidence of damage may be required.

Applicable Law and Courts of Jurisdiction:

All transactions undertaken through this website are governed by English Law and any legal actions arising out of such transactions shall be subject to the English legal processes and under the jurisdiction of English Courts.
